1. Acceptance of Terms
These Terms of Use ("Terms") govern access to and use of the SupremeTracking software, control panel (Console), website and services (the "Service"), operated by SupremeTracking (legal entity and tax ID to be provided) ("we", "our"). By creating an account, installing a Node or using the Service, you (the "User") represent that you have read, understood and agree to these Terms. If you do not agree, do not use the Service.
2. Description of the Service
SupremeTracking is a self-hosted server-side event tracking infrastructure: the User installs and operates an instance of the software (the "Node") on a server or hosting of their own choosing and responsibility. We provide the software, the usage license, provisioning and updates, the integrations catalog and the observability Console that reads directly from your Node.
Processing of your end users' events and conversion data occurs entirely on the User's infrastructure. We do not intermediate, store or process that data — as detailed in the Privacy Policy.
3. Registration and Account
To use features that require a license, the User must provide true, complete and up-to-date information. The User is solely responsible for keeping their credentials confidential and for all activity under their account. The Service is intended for users over 18, in a professional or business capacity.
4. Plans, Payment and Billing
The Service offers a free plan and paid plans. The prices, currency and features of each plan are those shown on the pricing page at the time of purchase. Charges are processed by third-party payment providers (for example, Stripe and Hotmart). Trial periods, where offered, convert to a paid plan only upon subscription. Unless otherwise required by law, amounts paid for periods already started are non-refundable.
5. User Responsibilities
The User is responsible for: (a) contracting and maintaining the hosting on which the Node runs; (b) using the Service in compliance with applicable laws, including data protection legislation; (c) obtaining, from their own end users, the legal bases and consents required to collect and process data; (d) correctly configuring their integrations and destinations; and (e) not using the Service for unlawful or fraudulent purposes, or in violation of third-party rights or the terms of the integrated platforms (Meta, Google, TikTok and others).
6. License and Intellectual Property
The software is licensed, not sold. We grant the User a limited, non-exclusive, non-transferable and revocable license to install and operate the Node while the license is active. All intellectual property rights in the software, brand, Console and documentation remain ours. Reselling, sublicensing, reverse engineering or removing ownership notices is prohibited, except with express authorization or as permitted by law.
7. Data and Privacy
The Service's architecture separates the control plane (licensing and billing, managed by us) from the data plane (your end users' events and personal data, which remain on your server). We do not access your conversion data. Data processing is governed by our Privacy Policy, an integral part of these Terms.
8. Availability, Updates and Support
We strive to keep the control plane and updates available, but the Service is provided "as is", without warranty of uninterrupted or error-free operation. Your Node's availability depends on the hosting you contract. We may provide software updates; keeping them applied is recommended. Support is provided through the channels and limits of the contracted plan.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for lost profits, data loss, unavailability of your hosting, media decisions made based on the data, or indirect damages arising from the use of or inability to use the Service. No advertising performance metric (such as EMQ, CPA or ROAS) is guaranteed — results depend on factors beyond our control.
10. Suspension and Termination
The User may stop using the Service at any time. We may suspend or terminate access in case of breach of these Terms, non-payment or misuse. Termination of the license does not affect the data residing on your own server, which remains under your control.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by reasonable means. Continued use of the Service after the changes take effect constitutes acceptance of the updated version.
12. Governing Law and Venue
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the district of Florianópolis, State of Santa Catarina, are elected to settle disputes, waiving any other, however privileged.
